Terms of Use for Hawaii Living LLC

Hawaii Living LLC, formerly known as Honolulu HI 5 LLC (name changed September 2017), operates the websites located at hawaiiliving.com and hawaiiliving.jp (collectively, the “Site”). Herein, Hawaii Living LLC is referred to as “HL,” and you, the consumer, are referred to as the “User.” All contracts and agreements entered into with HL are concluded in Hawaii.By accessing or using the Site, you agree to be bound by these Terms of Use and our Privacy Policy (collectively, the “Terms”). Please read these Terms carefully before using the Site. If you do not agree to these Terms, you must not access or use the Site.

1. No Professional Advice
The information on the Site, including but not limited to text, data, images, and other content, is provided for informational purposes only and does not constitute financial, legal, tax, or real estate advice, nor is it an offer to buy or sell property. Laws, regulations, tax rates, maintenance fees, governing documents, and other information change frequently. HL does not guarantee the accuracy, completeness, or timeliness of any information on the Site. Users should consult qualified professionals, such as financial planners, attorneys, or CPAs, for advice in their respective fields. HL is not responsible for any decisions made based on information provided on the Site.

2. Materials
The Site includes proprietary content created by HL, including but not limited to videos, photographs, floor plans, written content, blog posts, designs, logos, and the company name (collectively, “Materials”). Materials may include images or content generated or enhanced using artificial intelligence (AI) tools, which are intended for illustrative purposes only and may not accurately represent real-world conditions.
Users are strictly prohibited from:

  • Uploading, reproducing, or distributing Materials to any website, including the User’s own website, or using Materials for self-promotional purposes.
  • Translating, modifying, editing, or creating derivative works from the Materials.
  • Using Materials in any manner that violates these Terms or applicable laws.

Unauthorized use of Materials may result in legal action to protect HL’s intellectual property rights.

3. Accessibility
HL is committed to making the Site accessible to all users. We strive to comply with Web Content Accessibility Guidelines (WCAG) 2.1 to the extent reasonably practicable. However, due to the dynamic nature of web content and technological limitations, full compliance may not always be achievable. 4. Disclaimer of Warranty
The Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, or fitness for a particular purpose. The Site may contain errors, omissions, or outdated information, and HL does not warrant that the Site or its servers are free of viruses or other harmful components. Users assume all risks associated with the use of the Site, including any costs for servicing or replacing equipment or data resulting from such use.

The Site may link to third-party websites not controlled or endorsed by HL. HL is not responsible for the content, security, or practices of these websites, including any damages or costs arising from their use. Users access third-party websites at their own risk.

Materials, including but not limited to photographs, videos, and renderings of real estate projects (e.g., new condominiums or single-family homes), may be edited or AI-generated and are for illustrative purposes only. These Materials may not accurately reflect real-world conditions and should not be relied upon for purchasing or selling decisions. Project renderings and amenities depicted may change, may not exist, or may require permission from third-party owners for access. No representation is made that any project or amenity will be built as shown.

5. Limitation of Liability
To the fullest extent permitted by law, HL, its affiliates, officers, employees, contractors, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or related to the use of the Site, including but not limited to damages for loss of data, profits, or property, or costs to service or replace equipment. Users assume all risks associated with relying on the Site’s information, including Multiple Listing Service (MLS) data, Materials, or other content.

6. Indemnification
User agrees to defend, indemnify, and hold harmless HL, its affiliates, officers, employees, contractors, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from or related to User’s use of the Site, violation of these Terms, or infringement of any third-party rights.

7. Intellectual Property
All Materials and content on the Site created by HL are protected by copyright, trademark, and other intellectual property laws. Multiple Listing Service (MLS) data is provided under license from the respective MLS and is subject to their copyright and usage restrictions. Except as expressly permitted by these Terms or applicable MLS rules, Users may not reproduce, distribute, modify, or create derivative works from any content on the Site without prior written consent from HL or the respective MLS.

8. Privacy
HL values your privacy and will not sell your personal information. If you create an account on the Site (available only to Users 18 or older), HL may collect personal information such as your name, phone number, email address, and password. Submission forms on the Site may also collect similar information to process your requests and communicate with you.

The Site may use cookies to improve the User experience. Cookies can be disabled in your browser settings, though this may affect Site functionality.

While HL takes reasonable measures to protect your information, no online data transmission is 100% secure. Users share information at their own risk. To delete your account and associated data, sign in to your account and select “Deactivate Account” under the “Settings” tab, or email Info@HawaiiLiving.com from the registered email address.

9. Third-Party Services and Network
HL may refer inquiries to a network of licensed real estate agencies in Hawaii but does not endorse or assume responsibility for their actions or services. Users engage with such agencies at their own risk.

10. Email Disclaimer
Emails and attachments from HL are confidential and intended solely for the recipient. If you receive an email in error, please delete it and notify the sender. HL emails are not encrypted, and HL is not liable for errors, omissions, or damages resulting from email transmission, including interception, corruption, or viruses. Emails are for informational purposes only.

11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Hawaii, without regard to conflict of law principles. Any disputes arising from these Terms or use of the Site shall be resolved exclusively in the state or federal courts located in Honolulu, Hawaii. If any provision of these Terms is found invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. HL’s failure to enforce any right or provision does not constitute a waiver unless agreed to in writing.

12. Requirements of the Honolulu Board of Realtors
For All Users:
Some active listings on the Site may be listed by other REALTORS®. If you are interested in such listings, HL may represent you as the buyer’s agent. If the listing is HL’s, you may discuss representation options with one of our agents.

For Users Creating an Account:
  • By creating an account, you expressly agree to:Enter a lawful consumer-broker relationship with HL.
  • Use MLS-related information for personal, non-commercial purposes only.
  • Have a bona fide interest in the purchase, sale, or lease of Oahu real estate.
  • Not copy, redistribute, or retransmit MLS information except in connection with considering the purchase or sale of an individual property.
  • Acknowledge the MLS’s ownership and copyright of the MLS database.

For MLS and MLS Participants:
HL authorizes the MLS and its participants, or their authorized representatives, to create an account on the Site to verify compliance with MLS rules and monitor the display of their listings.

13. Specific to Realtors Association of Maui
MLS properties are based on information from the Multiple Listing Service of the REALTORS® Association of Maui. Information is deemed reliable but not guaranteed.

14. Specific to Hawaii Information Service
MLS properties and information are provided by Hawaii Information Service, Inc. and are deemed reliable but not guaranteed. 2025 Hawaii Information Service. All Rights Reserved. The Site is for personal, non-commercial use only.

15. Updates to Terms
HL may update these Terms at any time without prior notice. Continued use of the Site constitutes acceptance of the updated Terms. If you do not agree with any changes, you must stop using the Site immediately.
